Terms of Use of the Artificial Intelligence Assistant

1. General Description and Purpose

1.1. These Terms of Use of the Artificial Intelligence Assistant of the Construction Information System (hereinafter – the Terms) define the procedure by which users use the artificial intelligence assistant available in the Construction Information System (hereinafter – BIS) (hereinafter – the AI Assistant). The administrator of the AI Assistant is the State Construction Control Bureau (hereinafter – SCCB).

1.2. The AI Assistant is an automated information provision functionality that, using artificial intelligence technologies, automatically generates responses based on information sources selected by the SCCB (construction-related regulatory enactments, the BIS user manual, a compilation of frequently asked questions, explanations and guidelines, etc.).

1.3. The purpose of the AI Assistant is to provide BIS users (hereinafter – the User) with general informational support regarding the construction and operation process, as well as the use of BIS. The information provided by the AI Assistant shall not be regarded as an official and binding explanation, legal opinion, or decision of competent authorities.


2. Transparency and Requirements of the Artificial Intelligence Act

2.1. The User is informed that:

2.1.1. The User interacts with an automated information provision system without human involvement.

2.1.2. The responses provided by the AI Assistant:

2.1.2.1. may be incomplete, inaccurate, or outdated;

2.1.2.2. may contain non-existent information or so-called “hallucinations”;

2.1.2.3. do not create factual or legal consequences for the User.

2.2. The SCCB supervises the operation of the AI Assistant in order to improve the quality of responses; however, it does not control or verify individual conversations in real time, nor does it use the content of individual conversations for other purposes.

2.3. The User is responsible for verifying the information provided by the AI Assistant using official information sources or by contacting a competent authority, including in cases where the User intends to use the provided information for decision-making.

2.4. The User is encouraged to evaluate the quality of responses provided by the AI Assistant using the response evaluation functionality in order to ensure feedback and help improve the operation of the AI Assistant in the future.


3. Usage Restrictions and User Obligations

3.1. The User is prohibited from using the AI Assistant for unlawful purposes or for disrupting the operation of BIS.

3.2. The User undertakes to:

3.2.1. familiarise themselves with these Terms and comply with them;

3.2.2. refrain from actions that could endanger the security, stability, availability, or performance of BIS or the AI Assistant, including attempts to maliciously influence the operation of the AI Assistant or to deliberately mislead the AI Assistant;

3.2.3. refrain, when interacting with the AI Assistant, from using offensive, insulting, discriminatory, or obscene language, as well as from engaging in unlawful actions or actions contrary to generally accepted ethical standards.

3.3. The User is prohibited from entering into the AI Assistant:

3.3.1. special categories of personal data (for example, personal identification number, personal address, health data, criminal record data);

3.3.2. personal data or private information of other persons for the disclosure of which there is no legal basis;

3.3.3. classified information or information with restricted access.


4. Personal Data Processing

4.1. Personal data processing is carried out in accordance with applicable regulatory enactments and the SCCB privacy policy published on the SCCB website: https://www.bvkb.gov.lv/lv/privatuma-politika.

4.2. The purpose of personal data processing is the processing of text entered by the User so that the AI Assistant can prepare a response that is not of a binding nature.

4.3. Data entered during the use of the AI Assistant may be used to ensure the operation of the AI Assistant and to improve its quality. Conversation history is stored and analysis is carried out in an anonymised manner, without identifying a specific user. The collected data is used solely to improve the functionality of the AI Assistant, enhance the quality of its operation, and generate aggregated statistics.

4.4. The conversation history contained in the AI Assistant is stored for 1 year for statistical purposes and for improving the operation of the AI Assistant and is automatically deleted after the expiry of this period.


5. Limitation of Liability

5.1. The SCCB is not responsible for the truthfulness, accuracy, completeness, or suitability of the responses provided by the AI Assistant for a particular situation.

5.2. Responsibility for actions or decisions based on information provided by the AI Assistant lies with the User.

5.3. The SCCB is not liable for any losses or consequences incurred by the User in connection with information entered by the User and content generated by the AI Assistant, regardless of whether such content is used directly or indirectly.


6. Final Provisions

6.1. The SCCB is entitled to amend these Terms.
