On December 14 this year, the Saeima in its final reading approved amendments to the Residential House Management Law, ensuring the availability and use of the Building Information System (BIS) functionalities in relation to the management of residential house affairs documentation in BIS for every person managing a residential house of a certain size.
As known, since March 1, 2023, managing House Affairs in BIS has been mandatory. In the House Affairs section of BIS, data, information, and documents related to the management and maintenance of a specific residential house are displayed and maintained.
To access House Affairs in BIS, a manager responsible for organizing House Affairs documentation must register in the managers' registry. However, access to a specific residential house in the managers' registry is only granted if the manager has the appropriate education and professional qualifications, and a concluded management contract with the residential house community has been submitted. Unfortunately, in practice, especially in the regions, some managers are unable to register and access BIS House Affairs, thereby being unable to fulfill the management task of organizing House Affairs due to the lack of proper qualifications.
“It is positive that with the adoption of the legal amendment, an unnecessary bureaucratic barrier that hindered the normal process of managing residential houses has been removed. By step by step removing unnecessary restrictions in each sector, we are gradually moving towards more efficient administration, simplifying the business and societal life, in other words – creating a more people-friendly state,” emphasizes the Minister of Economics Viktors Valainis.
To ensure the continuity of the residential house management process and the opportunity for every residential house manager to use the BIS House Affairs functionality, the amendments approved by the Saeima will facilitate managers' access to the content of House Affairs in BIS. Going forward, the only prerequisite for registration in the managers' registry to gain access to the respective House Affairs in the Building Information System will be a concluded management contract between the manager and the apartment owners' association. Thus, every manager will be able to use the functionality created in BIS for organizing House Affairs in an electronic environment, including ensuring the decision-making process electronically, considering that the Apartment Property Law currently provides for the decision-making process also in an electronic environment.
Simultaneously, it is emphasized that these amendments do not change the professional qualification requirements for managers stipulated in the law, but they are equated to the requirements set out in the Professional Education Law.
